Jobsite Payment Changes - Subbies Must Be Paid on Time; Retention Money Returned; Tighter Rules for Surveyors and Plumbers; New Environmental Powers
Building Legislation Amendment (Fairer Payments on Jobsites and Other Matters) Bill 2025
1st House
2nd House
Law
Effects of Bill:
This bill being passed means that:
tradies and subcontractors will have a legal right to get their retention money or bank guarantees back, not just progress payments.
you can send a payment claim once a month, and contracts that try to stop you from doing that won’t count.
money owed (or retention money due back) has to be paid within 20 business days — contracts can’t drag it out longer.
“pay when paid” clauses are banned, and unfair time limits that are impossible to meet can be thrown out.
there’ll be a proper process for asking to get retention money or security back, with the same rights to go to adjudication if it’s not paid.
builders can’t bring up new reasons at the last minute for not paying — they’re stuck with what they put in their first response.
if you win at adjudication and still don’t get paid, you can get a court order fast, and the other side has to put up security if they want to fight it.
giving dodgy or false info about who the principal is, or failing to give required notices, can land people with fines.
surveyors and inspectors will need proper training, qualifications, and clean records to get registered.
surveyors must give owners key information about their permit applications within 10 business days, or face penalties.
the plumbing regulator can set and enforce official codes of conduct for plumbers.
developers will have to pay fees for environmental effect assessments and advice
courts can order people to replant or restore native vegetation if they’ve cleared it illegally.
