Effects of Bill:

This bill being passed means that:

a Code of Claimants’ Rights will be established, setting mandatory service standards for how compensation claimants are to be treated.

payments and support for families of deceased workers will change: Weekly support for dependent children will be set at 12.5% of the worker’s average weekly earnings. The provisional payment period will be extended from 13 weeks to 26 weeks. A new lump-sum grief and loss payment will be introduced. Access to support services will be expanded to cover services beyond psychological treatment.

return-to-work coordinators will be subject to new requirements: They must complete approved training, with employers required to provide time and resources. Employers that fail to comply may be fined up to 120 penalty units (individuals) or 600 penalty units (corporations).

the membership of WorkSafe advisory committees will change to require at least one person with lived experience of a serious workplace incident.

an independent review of the workers’ compensation system will become mandatory every five years, beginning in 2030.

the Workplace Injury Commission, WorkSafe’s board and CEO, and hearing-loss assessors will be subject to updated governance and operational provisions.
