Effects of Bill:
This bill being passed means that:
Boating functions that were under Department of Transport will be moved over to the Victorian Fisheries Authority
Bus operators will have a new consolidated registration/regulation scheme; Existing providers can keep going under the current guidelines, but new operators will need to demonstrate their competence and capacity to operate safely.
"Hazardous Areas" can be declared by the Department of Transport, and Vehicles carrying more than 9 people in "hazardous areas" will be required to follow specific driver licencing and vehicle requirements. This is aimed specifically at alpine areas.
Part of the Latrobe Golf Club will be acquired for the Alphington Link project (effectively a cycling track to the city)
Laws around assaulting or obstructing Fisheries Authorised Officers are cleaned up a bit so that anyone caught assaulting or obstructing a Fisheries officer faces harsher penalties, just like for any other transport related Authorised Officer.
Learner drivers caught driving unsupervised now face harsher penalties - a bigger fine and up to 6 months jail
Unlicensed driving now carries a harsher punishment
If a company owns a car, it's now illegal to not nominate the responsible driver if the company does it three or more times within a year.
The Secretary for Transport can now delegate different people to be able to issue rego standards compliance certificates - for example, it means someone can be authorised to clear defect notices.
The law is now clearer that you do not need to comply with an alcohol interlock condition when doing a driving test or when having a driving lesson
If you were caught speeding and would be disqualified, but you do not have a Victorian licence, you are banned from driving in Victoria for the time you would have been disqualified for speeding
If a road safety company (such as an alcohol interlock provider) changes its name, the rego can be transferred from the old name to the new name
If you are an interstate driver but you have an alcohol interlock condition as a condition of driving in your home state, you still have to have zero blood alcohol when driving in Victoria (and your alcohol interlock rules are still in force too)
Interstate drivers can get Victorian commercial passenger vehicle driver accreditation with their interstate drivers licence, without needing to also apply for a victorian drivers licence or a special exemption. (Yay for less red tape!)
It will now be illegal for an owner of a car to allow it to be used as an Uber etc if it isn't registered properly. There are stricter rules for cars that are used to provide paid transport services, and it is illegal to avoid complying by not registering properly
