Effects of Bill:
This bill being passed means that:
penalties for drink driving (driving with a prescribed blood alcohol concentration) while a child is in the vehicle will increase from a maximum fine of $1,600 and disqualification of 3 months to a maximum fine of $2,400 and disqualification of 6 months.
penalties for drug driving (driving with a prescribed drug in oral fluid or blood) while a child is in the vehicle will increase from a maximum fine of $1,100 and disqualification of 3 months to a maximum fine of $1,600 and disqualification of 6 months.
penalties for reckless or dangerous driving while a child is in the vehicle will increase from a maximum fine of $5,000 or imprisonment for 2 years to a maximum fine of $7,500 or imprisonment for 3 years.
the court will be required to consider the presence of a child in the vehicle as an aggravating factor when sentencing for these offences.
