SACAT updates - Federal Cases Will be Tranferred to Federal Court; Five Years and a Law Degree Counts as Qualified; Staff Being Sacked Doesnt Invalidate Findings
South Australian Civil and Administrative Tribunal (Miscellaneous) Amendment
1st House
2nd House
Law
Effects of Bill:
This bill being passed means that:
The definition of a legally qualified member of the tribunal now includes tribunal members who hold a law degree and have five years of relevant legal experience, so they can now oversee cases
Staff leaving or being sacked, or other administrative issues, do not invalidate tribunal decisions. This is now clearer in the law.
Federal cases lodged with SACAT will be transferred to the Federal Magistrates Court. This was probably already the case, the wording in the law has just been updated to reflect this more accurately.
