Effects of Bill:
This bill being passed means that:
The following are banned: Single-use plastic cutlery, straws, stirrers; Polystyrene foam cups, bowls, plates, and clamshells; This list can be added to, or exemptions made, in regulations. Regulation changes must be announced by the Government Minister responsible - on a website, with 8 weeks consultation.
Businesses cannot distribute or sell the banned plastic items specified, unless they're a manufacturer selling or distributing them to someone outside South Australia
Individuals who believed the product they were selling or handing out was not banned can use this as a defence.
Individuals can now be fined $1,000 up to $20,000 for lying to people and saying that specific single-use plastic items ARE NOT banned and then handing them out
Anyone producing oxo-degradable plastic (plastic which breaks down into a million tiny bits in sunlight) can be fined up to $20,000
Manufacturers must certify that plastic products do not contain any oxo-degradable plastics; and people who distribute plastic products (sell or hand out, either one) must be able to show manufacturer certification that the product does not include any oxo-degradable plastics. The penalty for not being able to do this without reasonable excuse is up to $20,000
Anyone who falsely says, before or in the process of selling a product, that it is not made of oxo-degradable plastic - when in fact it IS - will be liable to a fine of up to $30,000.
The minister can exempt the manufacture, sale and supply of plastic straws to people who have a disability and need them
Other exemptions can be made by regulation, as needed
