Effects of Bill:

This bill being passed means that:

Under strict conditions (such as adopting all babies from a multiple birth) non-commercial surrogacy is now legal for resident adult South Australian couples who have a reason they cannot become pregnant (infertility, medical conditions or adverse gender or sexual preferences).

The resulting child is not required to be biological offspring of either commissioning parent if there is a medical reason why this cannot be so (e.g. genetic conditions, infertility)
