New Safety Orders for Adults Who Disrupt or Cause Harm Near Schools

Education Amendment (School Community Safety) Bill 2026

1st House

2nd House

Law

This Bill was sponsored by Prue Car ( ALP )

Effects of Bill:

This bill being passed means that:

school principals and authorised staff can make immediate orders against adults (other than students or staff) behaving in ways that cause or risk imminent harm or serious disruption to a school

longer-term ongoing orders can be issued in writing against adults whose behaviour poses an unacceptable ongoing risk to school safety — the adult must be consulted and the order is limited to 12 months (extendable once)

ongoing orders can be reviewed internally and then challenged in NCAT

if an adult breaches an ongoing school safety order, the Minister can apply to the Local Court for a protection order imposing further restrictions for up to 12 months

contravening a court protection order is a criminal offence

when an order affects a parent or carer, special arrangements must be made to preserve their ability to communicate with and access their child at school
