Effects of Bill:

This bill being passed means that:

it is a criminal offence to knowingly display a Nazi symbol (such as a swastika or the Nazi salute) in public without reasonable excuse — penalties are higher if this occurs on or near a synagogue, Jewish school or the Sydney Jewish Museum

it is also an offence to engage in conduct publicly indicating support for Nazi ideology using Nazi imagery in a way that would cause a reasonable person to fear harassment, intimidation, or violence

police can direct a person they reasonably suspect of displaying a Nazi symbol to stop doing so, and failure to comply is an offence

the swastika used in a Buddhist, Hindu or Jain context is explicitly excluded from the offence — academic, artistic, educational and public interest purposes are also defences

the previous sunset clause that would have automatically repealed the Nazi symbol offences is removed, making the offences permanent law

being part of an authorised public assembly does not protect a person from prosecution for other offences committed during that assembly, including the Nazi symbol offences
