Effects of this bill
If this bill passes, it means that:
Public officers are taken to have acted in an official capacity when starting criminal prosecutions before this law begins.
This applies if the officer intended to act officially rather than privately.
Criminal proceedings started by ICAC officers before this law begins are now valid.
These ICAC proceedings must have followed written advice from the Director of Public Prosecutions.
Criminal proceedings started by LECC or former PIC officers before this law begins are now valid.
These LECC and PIC proceedings must have followed written advice from the Director of Public Prosecutions.
