Effects of this bill

If this bill passes, it means that:

The court can now make interim orders on its own motion against a 'relevant party' rather than only an accused person.
The definition of 'relevant party' expands to include people who are accused, found guilty, appealing a finding of guilt, or have had a finding of guilt set aside on appeal.
The court may make interim orders to protect a child when an order is made against a relevant party.
The court must provide an oral explanation of an interim order to the relevant party.
The court is required to give relevant documents to an adult relevant party.
Interim orders and related documents are served on the relevant party.
An interim order made against a relevant party is treated as an application for a family violence intervention order.
Provisions for mention dates and hearings for final orders now apply to the relevant party.
Courts can now make temporary safety orders on their own to protect victims of sexual, violent, or stalking offences during bail applications, appeals, or criminal trials.
Juries in trials for some sexual offences can now find a person not guilty of the main charge but guilty of a less serious alternative offence.
Stalking now includes harming or threatening to harm an animal if the victim sees it or finds out about it.
The definition of family violence now includes stalking a family member, using service providers to control a family member, or harming a pet to control a family member.
People can no longer apply for a family violence intervention order against a child under 12 years old.
Courts must order Victoria Legal Aid to provide lawyers for both the protected witness and the respondent during cross-examinations in family violence cases.
Prosecutors must tell a protected person, or their guardian, if their private health information or therapy notes will be used in court.
