People can no longer knowingly display Nazi symbols near synagogues, Jewish schools or the Sydney Jewish Museum; they face up to 2 years in prison.

Graffiti is now explicitly a public act for the purpose of threatening or inciting violence based on race, religion, sexual orientation, gender identity, intersex or HIV/AIDS status.

Courts must consider hatred or prejudice as an aggravating factor in sentencing if it partially or wholly motivated the crime.

Graffiti offences carry tougher penalties if the property marked is a place of worship.

The Minister must review these laws after 2 years; a report must be tabled in Parliament.
