A person commits an offence if they intentionally incite racial hatred through a public act; the act must make a reasonable target fear harassment, intimidation, violence, or for their safety.

Individuals face up to 2 years in prison or a 100 penalty unit fine; corporations face a 500 penalty unit fine.

The law does not apply to people quoting or referencing religious texts for religious teaching.

Courts ignore whether the offender's beliefs about race were correct; they also ignore whether anyone actually felt hatred or acted on it.

Only the Director of Public Prosecutions or a police officer can start a prosecution.

The Minister must review the law after 12 months; they must table a report in Parliament on whether the rules are still appropriate.
