Effects of this bill

If this bill passes, it means that:

A person commits an offence if they knowingly display a Nazi or terrorist organisation symbol in public without a reasonable excuse.
Individuals who display these symbols can be fined up to 200 penalty units (2026: $22,000) or jailed for up to 5 years, or both.
Companies or other entities that display these symbols can be fined up to 500 penalty units (2026: $55,000).
The law excludes symbols used for Buddhism, Hinduism or Jainism.
Displays for academic, artistic or educational purposes are not offences; this also applies to other purposes in the public interest.
Courts must deal with these charges on indictment.
The standard non-parole period for this offence is 1.5 years.
People are banned from publicly displaying Nazi symbols or symbols of terrorist organisations if they do so to show support for those groups.

Schedule 1 to the bill makes changes to section 93ZA of the Crimes Act. As I have said, it is currently not an offence under New South Wales law to display the symbols of a terrorist organisation. Given the state of tensions in the community, that is an unacceptable situation. The Coalition amendment will add to the outlawing of Nazi symbols those of a registered terrorist organisation as defined in the Commonwealth Criminal Code Act. Also, the Coalition amendment will add a new provision not yet in State or Federal legislation.
