Effects of this bill
If this bill passes, it means that:
Officers must attach a penalty notice or a written warning to a vehicle for a parking offence.
Officers must take photos of the offence and the attached notice; they must provide these to the issuing agency.
Officers who do not attach a notice must record their reasons; they must give a copy of these reasons to the issuing agency.
Issuing agencies must send the penalty notice within 7 days if no notice was attached to the vehicle; otherwise, the penalty is invalid.
Penalty notices are invalid if the officer failed to attach a notice and also failed to take photos.
Penalty notices are invalid if the officer failed to record the reasons for not attaching a notice.
Penalty notices are invalid if a similar offence occurred in the same spot within 7 days and no notice was attached for that earlier offence.
Agency heads must keep records of photos and reasons for not attaching notices; they must provide these to the driver or the Commissioner upon request.
