Effects of this bill
If this bill passes, it means that:
The Health Insurance (Pathology - Fees) Act 1991 and its Norfolk Island amendment are abolished.
The Commonwealth must refund fees paid under the abolished pathology fees law if the fee was for a pathology laboratory premises approval or a formal undertaking that starts on or after 1 July 2025.
When the Health Minister accepts a formal undertaking from a person, the Health Minister must give them a notice. This notice must state when the undertaking starts, how long it lasts, and how the person can request a review through the Administrative Review Tribunal.
The Health Minister can now approve or refuse a written application to have premises registered as an accredited pathology laboratory. If the Health Minister approves the premises, they must give a copy of the approval to the applicant.
