Effects of this bill
If this bill passes, it means that:
Corrupt conduct now includes any offence or serious disciplinary matter.
Conduct is corrupt even if a benefit was not actually obtained.
IBAC can assume a required state of mind when deciding if conduct is a serious disciplinary matter.
Public bodies and public officers now include any person or entity performing a public function for the State; this applies regardless of whether they are under contract.
Associated entities and their officers are no longer covered by the Public Interest Disclosures Act 2012.
The new rules apply to conduct occurring after the law starts; they also apply to active or unresolved investigations.
IBAC cannot reopen investigations or complaints that were finished or dismissed before the law started.
