Effects of this bill

If this bill passes, it means that:

A Child Protection Restraining Order can now be made against an adult who lives at, or often visits, a home where a child under 17 is present, provided the adult is not the child's guardian and no guardian lives at that home.
The Youth Court must be satisfied that a Child Protection Restraining Order is reasonably necessary before making the order.

The Debate

What different members said when this bill was debated:

Kyam Maher ALP

“I move: That this bill be now read a second time. Today, I introduce the Criminal Procedure (Child Protection Restraining Orders) Amendment Bill 2026. The bill amends the Criminal Procedure Act 1921 to enable a court to make a child protection restraining order in circumstances where the child for whom protection is sought was ’frequenting’ the premises of the defendant.”
