Effects of this bill
If this bill passes, it means that:
Donors are taken to have consented to the use of their gametes or embryos for completion of family arrangements; they can still modify or withdraw this consent.
ART providers cannot use a donated gamete or embryo if it would result in more than 5 families in the ACT; the limit is 10 families across Australia.
ART providers must provide mandatory information about the donor.
ART providers can use subsequent donated gametes or embryos for completion of family arrangements without following certain extended regulatory provisions; this applies if a person became pregnant before the transitional period ended.
ART providers are exempt from certain extended provisions when using embryos created before the end of the transitional period.
ART providers can use gametes allocated to a person before the end of the transitional period; certain basic or extended provisions will not apply depending on when the allocation happened.
