Effects of this bill
If this bill passes, it means that:
It is a criminal offence for people responsible for medical gas systems to maintain an unsafe system.
Pool owners must obtain a compliance status certificate if their pool lacks a building approval and certificate of occupancy; failure to do so is an offence.
Pool owners must lodge their compliance status certificate with the construction occupations registrar within 30 days of receiving it; failure to lodge is an offence.
Corporate construction licences are automatically suspended if the company enters administration, receivership or liquidation.
Certifiers must provide a copy of any section 43(2) notice and drawings of completed work during the building completion process.
People approving building manuals must now approve the manual.
Pool owners must get a compliance status certificate if their pool is not fully exempt and does not have building approval and a certificate of occupancy for the safety barrier.
Pool owners who receive a compliance status certificate before 1 May 2028 must lodge it with the construction occupations registrar within 30 days, or they face a fine.
Corporate licenses are automatically suspended if the company goes into administration, receivership, or liquidation.
Corporate or partnership licensees can now appoint an eligible, licensed individual as their nominee in writing.
Certifiers must provide a copy of any notice given to them under the Building Act and must provide approval of the building manual when completing building work.
People responsible for medical gas systems can be fined or jailed if the system is unsafe.
