Effects of this bill

If this bill passes, it means that:

Crown land subject to a mining tenement is now rateable land; this excludes miscellaneous licences and small prospecting licences
Local governments must extinguish rates and recovery costs charged on miscellaneous or small prospecting licence land between 1 July 2017 and 1 July 2025
Local governments must refund payments made for these extinguished rates within 28 days
People who paid these rates can sue the local government to recover the debt if it is not refunded within 28 days
Local governments cannot reassess rates or issue new rate notices for this land for the affected years
Mining tenement and petroleum lease holders are now classified as owners
Past local government actions based on the belief that licence land was not rateable are confirmed as lawful
