Effects of this bill
If this bill passes, it means that:
The Commonwealth does not have to follow rules of natural justice when making deals with foreign countries to receive non-citizens.
The Minister and Department officers can ignore natural justice rules when acting on these reception arrangements.
Natural justice rules no longer apply to specific powers under the Migration Act regarding visa and detention decisions.
Past actions regarding these reception arrangements are now valid; this applies even if natural justice rules were ignored.
Visa decisions made on or before 8 November 2023 are now valid; this includes decisions based on the belief that non-citizens with no prospect of removal could be detained.
